These Terms of Service govern your use of hushvo.com and purchases from Hushvo. Please read them before using the website or placing an order.

1. Agreement to these Terms

By visiting the website, creating an account, or purchasing a product, you agree to these Terms and the policies linked here. If you do not agree, do not use the website or place an order.

These Terms apply to all visitors, customers, and other users. Certain products, features, promotions, or services may have additional terms. If additional terms conflict with these Terms, the more specific terms control for that product, feature, promotion, or service, except where applicable law requires otherwise.

2. Eligibility and accounts

You must be able to enter into a binding agreement under the law that applies to you. If you allow another person to use your account or device, you are responsible for activity conducted through it to the extent permitted by law.

You agree to provide current, accurate, and complete information and to keep account credentials secure. Contact support@hushvo.com promptly if you suspect unauthorized access.

3. Acceptable use

You may use the website only for lawful personal or business shopping purposes. You must not:

• Break a law, infringe another person's rights, or use the website for fraud or deception.
• Upload malicious code; bypass security; probe vulnerabilities; disrupt the website; or interfere with another user's access.
• Use automated tools to scrape, copy, index, purchase, or interact with the website in a manner that creates an unreasonable burden or violates instructions presented on the site.
• Misrepresent your identity, submit false information, or make unauthorized payment attempts.
• Copy, reproduce, resell, or commercially exploit protected website content except with permission or as allowed by law.

4. Product information and availability

We work to describe and display products accurately, including dimensions, materials, colors, features, and availability. Screen settings, manufacturing tolerances, packaging, and natural material variation may cause reasonable differences from photographs or descriptions. Product packaging or specifications may change when doing so does not materially reduce the product's stated function or your legal rights.

Availability is not guaranteed. We may limit quantities, discontinue products, or correct product information. If a material correction affects an order you already placed, we will provide an appropriate option, which may include confirming the change or canceling and refunding the affected item.

Hushvo products are designed to support comfort and sleep preferences. Website content is general product information and is not medical advice, diagnosis, or treatment. Consult a qualified health professional about pain, injury, medical conditions, or individual health concerns.

5. Orders, acceptance, and cancellation

Submitting an order is an offer to purchase. An order confirmation acknowledges receipt but does not necessarily mean the order has been accepted. We may accept an order when payment is authorized and the order enters fulfillment, subject to applicable law.

We may reject, limit, or cancel an order for legitimate reasons, including product unavailability, pricing or listing errors, payment failure, suspected fraud, shipping restrictions, or violation of these Terms. If we cancel after charging you, we will refund the canceled amount to the original payment method.

Contact us as soon as possible if you want to change or cancel an order. We cannot guarantee a change after fulfillment begins. Any statutory cancellation right available where you live remains unaffected.

6. Prices, taxes, and payment

Prices, discounts, currencies, and product availability may change without advance notice, but a change will not alter an accepted order unless you agree or applicable law permits it. The checkout page shows the price charged for your order. Obvious pricing or description errors may be corrected as described in Section 5.

Taxes, duties, import charges, and other government fees may apply based on the order and destination. Amounts collected by Hushvo, if any, will be shown at checkout. Charges not collected at checkout may be assessed by a carrier or government authority and are your responsibility unless applicable law or the order terms state otherwise.

You authorize Hushvo and its payment providers to charge the payment method you select for the order total and any amounts you expressly approve. You represent that you are authorized to use that payment method. Payment services may be subject to separate provider terms.

7. Shipping and delivery

Shipping destinations, methods, costs, estimated delivery times, tracking, address requirements, customs information, and delay procedures are described in our Shipping Policy, which is incorporated into these Terms.

Delivery dates are estimates unless we expressly agree otherwise. Risk of loss and legal title pass as provided by applicable law and the shipping terms shown for your order. Nothing in this section reduces rights or remedies that cannot be waived where you live.

8. Returns, refunds, and comfort trials

Eligibility, request deadlines, item-condition requirements, return authorization, shipping responsibility, refund timing, damaged or incorrect products, and other procedures are described in our Return & Refund Policy, which is incorporated into these Terms.

A comfort trial applies only when the product page or your order expressly states that the product is eligible. Promotional trial terms do not automatically apply to every product. Mandatory return, refund, warranty, and cancellation rights under applicable law remain unaffected.

9. Promotions, discounts, and gift offers

Promotions may have separate eligibility rules, dates, exclusions, quantity limits, or redemption instructions. Unless the offer states otherwise, promotions cannot be combined, redeemed for cash, applied to past orders, or transferred. We may end or modify a promotion as permitted by law, and we may cancel use that results from error, fraud, abuse, or violation of the offer terms.

10. Reviews, feedback, and other submissions

If you submit a review, photo, comment, suggestion, or other content, you confirm that you have the right to provide it and that it is accurate, lawful, and does not violate another person's rights. Do not submit confidential information or content containing another person's personal information without permission.

You retain ownership of your content. You grant Hushvo a non-exclusive, worldwide, royalty-free license to host, reproduce, format, publish, translate, and display it for operating, improving, and promoting Hushvo, in any medium, subject to applicable law and our Privacy Policy. We may moderate or remove submissions that violate these Terms, but we are not required to publish every submission.

11. Intellectual property

The website and its text, graphics, product presentation, photographs, videos, design, trademarks, logos, and other content are owned by or licensed to Hushvo and are protected by applicable intellectual-property laws. Hushvo grants you a limited, revocable, non-exclusive, non-transferable right to access and use the website for its intended shopping purpose. No other right or license is granted except as expressly stated or required by law.

12. Third-party tools, links, and services

Our store is powered by Shopify and may use third-party services for payments, shipping, support, analytics, advertising, and other functions. Third parties may apply their own terms and privacy policies to services they provide directly to you.

Links to third-party websites are provided for convenience and do not necessarily mean Hushvo endorses them. We are not responsible for a third party's independent content, security, availability, products, or practices, except to the extent responsibility cannot be excluded under applicable law. Review the terms and policies of a third-party service before using it.

13. Privacy

Our collection and use of personal information are described in the Privacy Policy. Please review it before using the website or placing an order.

14. Errors, interruptions, and changes to the website

We try to keep the website accurate, secure, and available, but errors, interruptions, delays, maintenance, or technical issues may occur. We may correct errors, update content, suspend features, or change the website when reasonably necessary. If a correction materially affects an order, the protections in Section 5 apply.

15. Warranties and disclaimers

Products are covered by any express warranty stated on the applicable product page or provided with the product, plus any mandatory warranty or guarantee provided by law.

To the fullest extent permitted by applicable law, the website and any content made available without a separate express warranty are provided “as is” and “as available.” Hushvo does not promise that the website will always be uninterrupted, error-free, or free from harmful components. These disclaimers do not exclude any representation, warranty, guarantee, condition, or remedy that cannot legally be excluded.

16. Limitation of liability

To the fullest extent permitted by applicable law, Hushvo will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses, or for lost profits, revenue, data, goodwill, or business opportunity, arising from use of the website when such losses were not reasonably foreseeable.

Where liability may lawfully be limited, Hushvo's total liability arising from a product or order will not exceed the amount you paid for the product or order giving rise to the claim. This limit does not restrict a refund or replacement expressly available under our policies.

No exclusion or limitation in these Terms applies to liability that cannot be excluded or limited under applicable law, including liability for fraud or fraudulent misrepresentation and, where applicable, death or personal injury caused by negligence, gross negligence, willful misconduct, or breach of mandatory consumer rights.

17. Suspension and termination

You may stop using the website at any time. We may suspend or terminate access when reasonably necessary to protect the website, customers, Hushvo, or others; investigate suspected fraud or security incidents; comply with law; or address a material violation of these Terms. Provisions that by their nature should continue after termination—including payment obligations, intellectual property, disclaimers, liability limitations, and dispute terms—will survive. Termination does not cancel rights or obligations that arose earlier.

18. Governing law and disputes

These Terms and any dispute relating to them are governed by the laws applicable to Hushvo's operation and the relevant transaction, without regard to conflict-of-law principles, except that you keep the benefit of mandatory consumer protections provided by the law of your country, state, or region of residence.

Before starting formal proceedings, please contact support@hushvo.com so we can try to resolve the issue. Nothing in these Terms requires arbitration or prevents either party from bringing a claim before a court, consumer tribunal, regulator, or other authority that has jurisdiction under applicable law.

19. Severability, waiver, and assignment

If a provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted or modified only as much as necessary, and the remaining provisions will continue in effect. A delay or failure to enforce a provision is not a waiver.

You may not transfer your rights or obligations under these Terms without our consent, except where applicable law permits it. Hushvo may transfer these Terms as part of a reorganization, financing, merger, acquisition, or transfer of a business, provided the transfer does not reduce mandatory rights.

20. Entire agreement and changes

These Terms, the policies linked in them, and any additional terms presented for a specific product, promotion, or service form the agreement between you and Hushvo concerning the website and your order. They replace prior discussions or statements about the same subject, but do not override an express product warranty or a mandatory legal right.

We may update these Terms to reflect changes to our services, practices, or legal obligations. The revised Terms will be posted here with a new “Last updated” date. Changes apply prospectively from the effective date unless applicable law requires otherwise. If a material change requires notice or consent, we will provide it as required.
